Terms & Conditions — Smackz Distribution LLC

Introduction & Acceptance

These Terms & Conditions (“Terms”) govern your use of www.officialsmackz.com (“Site”) and purchases from Smackz Distribution LLC (“Smackz”, “we”, “us”, or “our”). By accessing the Site or purchasing products you accept and agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility & Age Requirement

Products and events are restricted to persons who are at least 21 years old. By placing an order you represent and warrant that you are at least 21 years of age. Smackz reserves the right to refuse service or cancel orders where age verification fails or where local law prohibits sale or distribution.

Hemp Compliance Statement

All products sold by Smackz are hemp-derived and contain no more than 0.3% Delta-9 THC by dry weight, consistent with the Agriculture Improvement Act of 2018 (“2018 Farm Bill”). We do not sell marijuana or products derived from marijuana or products containing synthetic cannabinoids (e.g., HHC, THC-O).

Ordering & Acceptance

All orders are subject to acceptance by Smackz. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, suspected violations of law, or inventory inaccuracies. An order confirmation email does not constitute acceptance; acceptance occurs when the product ships or we send a shipping confirmation.

Product Descriptions & Labeling

We strive to provide accurate product information and ingredient lists. Product formulations and labels may change. All claims are made in compliance with federal guidance; Smackz does not make medical claims or imply therapeutic benefits.

Pricing & Payment

Prices are in USD and are subject to change. Payment is required at the time of order. We use third-party PCI-compliant payment processors. We reserve the right to verify billing details and to cancel orders for suspected fraud or non-compliance.

Shipping & Delivery

Shipping policies and procedures are detailed on our Shipping Policy page. Some orders may require a signature and age verification upon delivery. Smackz is not responsible for delays caused by carriers or customs (if applicable).

Returns, Refunds & Cancellations

Due to the consumable nature of our products, most sales are final once shipped. Refunds and cancellations are governed by our Refund & Cancellation Policy (link). If you dispute a charge, we will request documentation such as proof of delivery, COA batch numbers, and communication records to resolve the matter.

Use Restrictions

You agree not to use the Site or products to: (a) sell or transport products into jurisdictions that prohibit hemp-derived product receipt; (b) repackage or relabel products in a way that obscures batch numbers or COAs; (c) make medical claims about products; or (d) engage in illegal or fraudulent activity.

Intellectual Property

All content on the Site, including logos, graphics, text, and product images, is the property of Smackz or its licensors. You may not reproduce content without our express written permission.

Disclaimer & Limitation of Liability

Smackz provides products “as is” and disclaims all warranties to the maximum extent permitted by law. Smackz shall not be liable for indirect, incidental, special, or consequential damages. Our aggregate liability for direct damages shall not exceed the purchase price of the product that gives rise to the claim.

Indemnification

You agree to indemnify and hold Smackz harmless from any third-party claims arising from your use of the Site or your breach of these Terms.

Governing Law & Dispute Resolution

These Terms are governed by North Carolina law. Parties will attempt to resolve disputes by good faith negotiation; unresolved disputes may be submitted to binding arbitration in Cumberland County, NC, subject to applicable law.

Termination

We may suspend or terminate accounts, orders, or Site access for violations of these Terms or for suspicious activity.
